1. Who we are

Marketectify ("we", "us") is an AI automation, performance marketing, and website development agency operating from Karachi, Pakistan. By using this website or engaging our services, you agree to these terms.

2. What these terms cover

These terms govern general use of this website and set the baseline for our working relationship. Any specific project is also governed by a separate written proposal or agreement. Where a signed proposal conflicts with these terms, the signed proposal wins.

3. Our services

We provide AI automation and AI agents, performance marketing (Meta and Google Ads, retargeting, conversion optimisation), and website development (business sites, e-commerce, landing pages, booking, real estate, school/LMS). Exact scope, deliverables, and timelines are defined per project in your proposal.

4. Pricing and payment

• Prices shown on this website are starting prices and indicative ranges. Your final quote depends on scope.
• Quotes are valid for 14 days unless stated otherwise.
• Monthly retainers are billed in advance. One-time builds are typically billed 50% upfront and 50% before handover, unless agreed otherwise in writing.
• The one-time setup fee is non-refundable once work has begun, since it covers the time we spend building and configuring your system. If you cancel before we start, any upfront payment is refunded in full.
• Advertising spend is separate from our management fee and is paid by you directly to the ad platform — we never hold or move your ad budget.
• Third-party costs (hosting, domains, Shopify subscriptions, premium plugins, paid APIs) are billed to you at cost and are not marked up by us.
• All prices are in Pakistani Rupees (PKR) unless stated otherwise. You are responsible for any applicable taxes.

5. Results, estimates, and what we do not guarantee

This section matters, so we are being direct about it.

Any figures on this website or in our proposals — including percentages, ROI ranges, cost-per-lead estimates, timelines, and industry examples — are illustrative estimates based on what our systems are designed to deliver. They are not promises, warranties, or guarantees of the results your specific business will achieve.

Marketing and automation outcomes depend on many factors outside our control, including your market, your pricing, your offer, your sales follow-up, your budget, seasonality, competitor activity, and platform policy changes. We do not guarantee any specific revenue, lead volume, ranking, conversion rate, or return on investment.

Where a specific performance commitment is offered, it will be stated explicitly in your signed proposal, with its exact conditions. Nothing on this website constitutes such a commitment.

6. Your responsibilities

To deliver on time, we need you to:

• Provide content, brand assets, and account access when requested
• Give feedback and approvals within agreed timeframes
• Ensure anything you supply to us (logos, images, copy, product data) is legally yours to use
• Maintain your own ad account billing and platform compliance
• Respond to leads our systems generate — automation delivers the enquiry, your team closes the sale

Delays in the above will shift project timelines accordingly.

7. Ownership of work

Once a project is fully paid for, you own the deliverables — your website, your automation workflows, your ad account, your data. Wherever technically possible, systems we build run on your own WhatsApp Business API, CRM, and Shopify (or equivalent) accounts — not ours — so your data stays in accounts you control and you are not locked into working with us.

We retain ownership of our underlying methods, internal templates, and general know-how. Third-party components (plugins, themes, platforms) remain governed by their own licences.

Unless you ask us in writing not to, we may reference our work with you in our portfolio and marketing. We will not publish your name, metrics, or a testimonial without your explicit permission.

8. Confidentiality

We keep your business information, data, and strategy confidential, and we expect the same regarding our proposals and pricing. This survives the end of our working relationship.

9. Cancellation

Monthly retainers can be cancelled anytime, with 30 days' written notice from either side — there is no long-term lock-in contract. Fees for the current billing period are not refundable, but no further invoices will be raised. On termination we hand over your accounts, assets, and access, and our own access to your systems is revoked.

One-time projects cancelled mid-build are billed for work completed to that point.

10. Limitation of liability

To the maximum extent permitted by law, our total liability for any claim relating to our services is limited to the fees you paid us in the three months before the claim arose. We are not liable for indirect or consequential losses, including lost profits, lost revenue, or lost data.

We are not liable for outcomes caused by third-party platforms — for example ad account suspensions, algorithm or policy changes, API changes, or service outages at Meta, Google, WhatsApp, Shopify, or your hosting provider.

11. This website

We work to keep information on this site accurate but do not warrant that it is complete or error-free, and we may change pricing or service descriptions at any time. The site is provided "as is". Branding, copy, and design on this site are ours; please do not copy them.

12. Governing law

These terms are governed by the laws of the Islamic Republic of Pakistan, and the courts of Karachi have jurisdiction over any dispute. Before starting formal proceedings, both sides agree to attempt to resolve the issue in good faith directly.

13. Changes to these terms

We may update these terms. The "last updated" date above will change. Continued use of the site or our services after an update means you accept the revised terms. Active clients will be notified directly of material changes.

14. Plain language, not legal advice

We have written this page in plain language so you can actually read and understand it, not to bury you in legalese. It is a genuine description of how we work. That said, it is not a substitute for independent legal advice on your specific situation — if you need that, please consult a lawyer.
